1. Acceptance of Terms
These Terms & Conditions (“Terms”) govern your access to and use of the HomeVein platform, including all websites, applications, and services (collectively, the “Platform”).
The Platform is operated by HomeVein Inc. (“HomeVein”, “we”, “us”, or “our”).
By creating an account, accessing, or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you must not use the Platform.
2. Eligibility and Account Registration
To use HomeVein, you must:
Be at least 18 years old
Have the legal capacity to enter into a binding agreement
Provide accurate, complete, and current information
You are responsible for:
Maintaining the confidentiality of your account credentials
All activities that occur under your account
HomeVein reserves the right to suspend or terminate accounts at its discretion.
3. Description of Services
HomeVein operates solely as a technology platform that enables users to:
Store, organize, and manage property-related data and documents
Track home details, maintenance, and project history
Manage items, warranties, and service records
Collaborate with third parties (e.g., contractors, insurers, service providers)
Facilitate the transfer of property-related data to other users (e.g., buyers)
HomeVein does not provide legal, financial, construction, insurance, or other professional advice.
4. Platform Nature and No Professional Relationship
You acknowledge that:
HomeVein is not a licensed professional service provider
No fiduciary, advisory, or professional relationship is created
Any reliance on the Platform is at your own risk
5. User Content and Data
5.1 Ownership
You retain ownership of all data, documents, and content you upload (“User Content”).
5.2 License to HomeVein
You grant HomeVein a worldwide, non-exclusive license to:
Store, process, and display your data
Operate, maintain, and improve the Platform
Develop new features and services
5.3 Responsibility for Content
You are solely responsible for:
Accuracy and completeness of your data
Ensuring you have rights to upload and share content
Maintaining backup copies of critical documents
HomeVein does not verify the authenticity, legality, or enforceability of any uploaded content.
6. Data Collection and Privacy
HomeVein collects and processes:
Personal information (e.g., name, email, phone number)
Property details (e.g., address, specifications, history)
Project, maintenance, and item data
Third-party contact information
We use this data to:
Provide and improve the Platform
Enable functionality
Enhance user experience
We do not sell your personal data.
Use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
7. Data Storage, Availability, and Risk
You acknowledge that:
Data may be subject to loss, corruption, or unauthorized access
No system is completely secure
Continuous availability is not guaranteed
HomeVein does not guarantee:
Permanent storage of data
Error-free or uninterrupted service
You are responsible for implementing appropriate safeguards, including maintaining backups and securing your account credentials.
8. Third-Party Services and Interactions
The Platform may enable interactions with third parties.
HomeVein:
Does not endorse or verify third parties
Is not responsible for their services, actions, or outcomes
Is not a party to agreements between users and third parties
You are solely responsible for vetting and managing contractors, service providers, and other third parties.
9. Property Data and Ownership Disclaimer
HomeVein may allow the transfer of property-related data to another user (e.g., a buyer).
You acknowledge that:
Such transfers are provided for convenience only
HomeVein does not verify completeness or accuracy
Transferred data may be incomplete, outdated, or inaccurate
HomeVein does not:
Verify property ownership
Establish, transfer, or confirm legal ownership of real estate or assets
The Platform is not a land registry, title system, or legal record.
10. Subscription Plans and Payments
10.1 Paid Services
Certain features may require a paid subscription.
10.2 Billing
By subscribing, you agree:
To pay all applicable fees
That billing may be recurring (monthly or annually)
That payments may be processed through third-party providers
10.3 Changes to Pricing
HomeVein may modify pricing with reasonable notice.
10.4 Refunds
Fees are non-refundable except where required by applicable law.
10.5 Suspension for Non-Payment
Failure to pay may result in suspension or termination.
11. Acceptable Use
You agree not to:
Use the Platform for illegal or fraudulent purposes
Upload harmful, misleading, or unauthorized content
Upload false property ownership or claims
Impersonate any person or entity
Misrepresent property condition or history
Attempt to access unauthorized areas of the Platform
Interfere with system integrity or security
12. Intellectual Property
All rights in the Platform (excluding User Content) are owned by HomeVein.
You may not:
Copy, modify, or distribute the Platform
Reverse engineer or attempt to extract source code
13. Platform Disclaimer
HomeVein is a technology platform only.
It is not:
A government registry
A land title system
A legal archive
A certified document storage authority
Data stored on the Platform:
May not be legally recognized
May not be admissible in legal or insurance proceedings
Should not be relied upon as official records
14. Limitation of Liability
To the fullest extent permitted by law, HomeVein shall not be liable for:
Loss of data or documents
Property-related decisions or outcomes
Financial losses or damages
Disputes with third parties
Errors, omissions, or inaccuracies in data
Service interruptions or outages
15. Liability Cap
If liability cannot be excluded, HomeVein’s total liability is limited to the greater of:
The total fees paid by you in the last 12 months, or
CAD $100
16. Indemnification
You agree to indemnify and hold harmless HomeVein from any claims arising from:
Your use of the Platform
Your data or content
Your interactions with third parties
Your violation of these Terms
17. Termination
HomeVein may suspend or terminate your access:
For violation of these Terms
For non-payment
At its discretion
You may stop using the Platform at any time.
18. Modifications to the Platform
HomeVein may:
Modify, suspend, or discontinue features
Update the Platform at any time
19. Changes to Terms
We may update these Terms periodically. Continued use constitutes acceptance of the updated Terms.
20. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
21. Dispute Resolution
Any disputes shall be resolved exclusively in the courts of Ontario, Canada, unless otherwise required by applicable law.
22. Entire Agreement
These Terms constitute the entire agreement between you and HomeVein.

24. Data Retention and Deletion
Upon account termination, HomeVein may delete or anonymize your data after a reasonable retention period, except where required by law.
You are responsible for exporting any data prior to account closure.

The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
26. Force Majeure
HomeVein shall not be liable for delays or failure resulting from causes beyond its reasonable control, including but not limited to natural disasters, cyber incidents, infrastructure failures, or service outages.
27. Beta Features (If Applicable)
Certain features of the Platform may be in beta or early access and may contain bugs, errors, or incomplete functionality.
28. Automated and AI Features
Certain features may use automated or AI-based processing.
You acknowledge that:
Outputs may be inaccurate or incomplete
Such outputs should not be relied upon without independent verification
